ASIF ALI JOKHIO & CO is a law firm in Karachi, Pakistan, led by Advocate Asif Ali Jokhio (Advocate High Court, 19+ years of practice). The firm represents clients before the Sindh High Court and the City Courts Karachi in criminal and bail, family and khula, property, rent, constitutional (Article 199), NAB/FIA, succession, banking and corporate matters, including cases for overseas Pakistanis.
Pre-arrest (protective) bail is sought under Section 498 of the Code of Criminal Procedure from the Sessions Court or the Sindh High Court. The court must be satisfied that the intended arrest is for mala fide or ulterior reasons, such as harassment or humiliation, and that the case merits protection. Interim bail is often granted at the first hearing and later confirmed or recalled, so act quickly once an FIR is registered or an arrest is feared.
Post-arrest bail is governed by Section 497 Cr.P.C. Where the offence does not fall within the prohibitory clause (offences punishable with death, imprisonment for life or ten years or more), bail is generally the rule and refusal the exception. Even in serious offences, bail can be granted where the case calls for further inquiry, or on statutory grounds such as delay in the conclusion of the trial.
Yes, in suitable cases. The High Court can quash proceedings under Section 561-A Cr.P.C. or in its constitutional jurisdiction where an FIR discloses no offence, is registered without legal basis, or amounts to an abuse of process. Courts often expect the accused to first use remedies before the trial court, such as an application under Section 249-A or 265-K Cr.P.C., so the right route depends on the stage of the case.
A suit for dissolution of marriage on the basis of khula is filed in the Family Court under the Family Courts Act, 1964. If the court's attempt at reconciliation fails, it may dissolve the marriage, usually directing the return of dower received. Related claims — maintenance, dower, dowry articles and custody of children — can be pursued in the same or connected proceedings.
Custody is decided by the Guardian Court under the Guardians and Wards Act, 1890, and the welfare of the child is the paramount consideration. Mothers are generally preferred for young children, but the court looks at each child's age, wishes, schooling and the circumstances of both parents. The parent without custody is usually granted a visitation schedule.
Keep title documents and records up to date, and act immediately if someone occupies or tries to sell your property. A complaint can be filed under the Illegal Dispossession Act, 2005 against unlawful occupants, and a civil suit with an injunction can stop transfers. If you appoint someone to act for you, use a specific power of attorney attested by the Pakistani mission abroad rather than wide general powers.
A succession certificate allows legal heirs to collect a deceased person's bank balances, shares and other movable assets. It is obtained from the competent court under the Succession Act, 1925, after notice to all legal heirs and publication of a public notice. Immovable property passes to the heirs through mutation of the land or property records in their names.
Ejectment is sought by filing a rent application before the Rent Controller under the Sindh Rented Premises Ordinance, 1979. Common grounds include default in payment of rent, the landlord's personal bona fide need, unauthorised subletting and damage to the premises. A written tenancy agreement and rent receipts make the case considerably stronger.
